These terms are a contract between you and Hoopspot, the seller and operator of the Hoopspot pickup basketball app and website ("the app"). Hoopspot is the registered legal name of the seller and is operated as a sole proprietorship. In these terms "Hoopspot", "we", "us", and "our" all refer to this seller. By creating an account or using the app you agree to these terms. If you do not agree, do not use the app.
You must be at least 13 years old. You are responsible for keeping your login credentials secure and for all activity under your account.
Basketball is a physical activity that carries risk of injury. Hoopspot only helps players find courts, coordinate pickup games, and post quest videos. Hoopspot is not responsible for the condition of any court, the conduct of other players, or any injury, loss, or damage that occurs before, during, or after a game.
You are solely responsible for the courts you add, the check-ins you post, the videos you link, and any other content you submit. You must have the right to share anything you post. You grant Hoopspot a non-exclusive license to display your content within the app so other users can see it.
Do not post content that is illegal, hateful, harassing, sexually explicit, or that reveals someone else's private information.
Match results and player ratings are based on what users report and confirm. Ratings, tiers, and leaderboards are provided for entertainment. Hoopspot may adjust ratings or remove matches that appear to be manipulated.
We may remove content, suspend accounts, or refuse service at our discretion if we believe these terms have been violated.
Hoopspot offers optional paid features (for example "Hoopspot Pro"). By purchasing, you agree to the price, billing frequency, and renewal terms shown at checkout. Subscriptions renew automatically at the end of each billing period at the then-current price until you cancel. You can cancel at any time from your account or through the payment provider's customer portal; access to paid features continues until the end of the current paid period. Prices exclude applicable taxes, which are calculated and shown at checkout. Refunds are handled under our Refund Policy.
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Any questions about billing, invoices, taxes, refunds, or payment methods can be sent to Paddle at paddle.net.
We may suspend or terminate your access for material breach of these terms, non-payment of fees, suspected fraud or security risk, or repeated or serious violations of our community rules. You may stop using the app at any time.
The app is provided "as is" without warranties of any kind, to the fullest extent permitted by law. To the maximum extent permitted by law, Hoopspot's aggregate liability arising out of or relating to the app is limited to the greater of the fees you paid to us in the twelve months before the claim, or CAD $50. We are not liable for indirect, consequential, or special damages. Nothing in these terms limits liability that cannot be limited by law.
We may update these terms. Continued use of the app after changes means you accept the new terms.
